NECESSITY FOR LEGISLATION AND CHANGES TO EXISTING LAW The goal is to change the deadline of the annual report to a date that is harmonious with quarterly reports made by the Department of Buildings & Regulatory Compliance (“BRC”) to the Historic Resources Commission (“HRC”), as well as to ensure consistency of the delivery of the annual report between past and future practices, based on practicality. Currently, the Code § 42-91(B) requires the HRC to prepare and submit an annual report to the Mayor and Common Council on or before April 1 of each year concerning emergency actions pursuant to Code § 133-55 relating to landmarks or property within historic districts. It appears that there is no known reason why the April 1 deadline was selected for the annual report. Pursuant to Code § 133-78.6, the BRC has a Vacant Building Registry quarterly reporting requirement to the HRC, among other entities, due by January 15, April 15, July 15, and October 15 of each year. The BRC’s quarterly reports to the HRC include information on emergency actions pursuant to Code § 133-55. Such information contained in the BRC’s quarterly reports overlaps with the information that the HRC is to report on in their Emergency Action annual report pursuant to § 42-91(B). The proposed legislation would change the deadline of the HRC’s annual report from April 1 to August 1, a date which would allow the HRC to fully review information contained in the quarterly reports for inclusion in the HRC’s annual report. In addition, the HRC’s annual reporting requirement under § 42-91(B) was recently codified with the enactment of Local Law M of 2020 in March 2021. Due to the practicality of when the reporting requirement took effect in March 2021, the HRC filed its first annual report in August 2021. The proposed legislation would change the deadline of the annual report from April 1 to August 1 to ensure consistency of the delivery of the annual report between past and future practices. Council Members Johnson and Kimbrough, with the support of Council President Ellis, introduced the following: Resolution Number 40.42.22R A RESOLUTION OF THE COMMON COUNCIL CONGRATULATING THE ALBANY HIGH SCHOOL BOYS’ BASKETBALL TEAM AND CONGRATULATING ISAIAH AUSTIN, WHO WAS NAMED TO THE SECTION 2 CLASS AA ALL- TOURNAMENT BASKETBALL TEAM WHEREAS, the Albany Falcons boys’ basketball team advanced to the Class AA semifinals after a great season of 16 wins and were seeded 5th place going into the playoffs in their first trip to the Class AA Final Four since 2011; and WHEREAS, this was a great season for the Falcons, resulting in the most wins for the boys in more than two decades; and WHEREAS, they beat Guilderland to advance to the quarter finals, where they won a decisive victory against Shenendehowa at Hudson Valley Community College; and WHEREAS, the Falcons’ leading scorer during several pivotal matches was Isaiah Austin, who is the first member of the boys’ team in 19 years to score 1,000 career points; and WHEREAS, the Falcons’ defense helped them win their matchups with both Guilderland and Shenendehowa; and WHEREAS, the Falcons’ Coach Sean Brown’s leadership and coaching enhanced the student’s ability and allowed them to dominate on the floor. FISCAL IMPACT(S) N/A Council Member Love introduced the following: RESOLUTION NUMBER 44.42.22R A RESOLUTION OF THE COMMON COUNCIL DECLARING APRIL 19-25TH, 2022 TO BE MINORITY CANCER AWARENESS WEEK IN THE CITY OF ALBANY WHEREAS, the Common Council recognizes the importance of quality health care for all people; and WHEREAS, cancer death rates for minority groups have declined recently but remain notably higher than non-minority groups; and WHEREAS, many minorities have limited access to medical care or cannot afford the necessary testing to identify cancer; and WHEREAS, the goal of Minority Cancer Awareness Week, which runs from April 29th to April 25th, 2022, is to increase public awareness of the disparities in cancer screening, prevention, and treatment that exist among various ethnic and racial groups; and WHEREAS, it is incumbent upon all individuals to better educate themselves and their communities about early cancer detection and the importance of screening and regular check-ups; and WHEREAS, African Americans are more likely to develop and die from cancer than any other racial or ethnic group; and WHEREAS, while Hispanics or the Latinx population have a lower incidence for all cancers combined, they have a higher incidence of cancers associated with infection, such as cervical, liver, and stomach cancers; and WHEREAS, Asian Americans and Pacific Islanders also have a lower incidence of most common cancers but like African Americans, Hispanics, and other ethnic and racial groups they are disproportionately dying from cancers that are treatable if detected early; NOW, THEREFORE, BE IT RESOLVED, that the Albany Common Council declares April 19th through 25th as Minority Cancer Awareness Week in the City of Albany and encourages all residents to commit to staying informed about cancer, prevention, screening, and treatment; and BE IT FINALLY RESOLVED, that a copy of this resolution, suitably engrossed be transmitted to our legislative partners in the New York State Senate and Assembly to demonstrate our commitment to the eradication of cancer in all our communities and making sure that everyone has access to affordable health care. Council Member Robinson introduced the following: RESOLUTION NUMBER 45.42.22R A RESOLUTION OF THE COMMON COUNCIL HONORING THE LIFE AND LEGACY OF CYHNA FORNEY AND RENAMING ESSEX STREET IN HER HONOR WHEREAS, Chyna Unique Forney was the 18 year old daughter of Shannon Forney and Michael Anderson, Sr.; and WHEREAS, Chyna was a young woman of many talents, who was described as “bubbly,” possessed of a “radiant, infectious smile and personality,” and “the life of the party,” but was also known to be also “determined” and “career-focused;” and WHEREAS, Chyna was a member of the Albany Leadership Charter High School for Girls Class of 2021, having also attended Arbor Hill Elementary School and Hackett Middle School; and WHEREAS, Chyna ran track, indoors and outdoors, for Albany Leadership, and planned to continue her athletic pursuits in college; and WHEREAS, in 2017 Chyna became the captain of the Tone Setter Step Team, which she had joined in 2013 and for which she played a pivotal role, making up many steps and chants and becoming a sister to her entire Tone Setter family; and WHEREAS, Chyna joined the 2 Hot 4 U dance team in 2015, became captain only a year later, and similarly used her talents and love for dancing to craft routines and represent her team with passion; and WHEREAS, Chyna entered the workforce at the age of 14, and rose to the position of manager by the age of 18; and WHEREAS, Chyna planned to pursue a career in nursing after graduating from high school; and WHEREAS, Chyna’s life was cut tragically and suddenly short, on May 3, 2021, by a senseless act of violence on Essex Street, just weeks before she was set to graduate from high school; and WHEREAS, this beloved and accomplished young woman left behind her mother, sister, brothers, grandmother, and many aunts, uncles, cousins, godparents, and friends to mourn, remember, and celebrate her; NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Albany honors the life and legacy of Chyna Forney; and BE IT FINALLY RESOLVED, that Essex Street shall be renamed “Chyna Forney Way” in her honor. Forney, who was tragically and senselessly killed at the age of 18 in a drive-by shooting on Essex Street. The resolution would rename the entirety of Essex Street, which runs between Watervliet Avenue and Rawson Street, in Ms. Forney’s honor (a map of the proposed street is attached). NECESSITY FOR LEGISLATION AND ANY CHANGE TO EXISTING LAW Sections 323-63.2 and 323-63.3 of the Code of the City of Albany require the Common Council to review and approval all applications for honorary street renamings. Such approval is done by resolution of the Council. FISCAL IMPACT None. REQUESTED TIMEFRAME FOR PASSAGE The Council is asked to introduce and pass this resolution at its April 18, 2022 meeting, because Ms. Forney’s mother is hoping to have the honorary street signs bearing Ms. Forney’s name unveiled on the May 3 anniversary of her death.
